Appello internazionale: attivare il meccanismo “Uniting for Peace” all’ONU per fermare il genocidio in Palestina
Segue il testo integrale della lettera inviata a tutte le rappresentanze nazionali presso le Nazioni Unite, a partire dalla versione originale in inglese. La petizione è firmata da numerose associazioni di avvocati a livello internazionale, tra cui anche associazioni già accreditate all’ECOSOC (Economic and Social Council delle Nazioni Unite, che conferisce alle ONG con status consultivo la possibilità di partecipare alle riunioni, presentare dichiarazioni, organizzare eventi e svolgere attività presso la sede ONU).

Appeal to Invoke the ‘Uniting for Peace’ Mechanism
The Israeli genocidal aggression against the Palestinians is causing new victims every day. The United Nations has officially established the existence of a situation of widespread famine in Gaza, deliberately provoked by the Israeli government as part of its genocidal strategy aimed at implementing its final solution against the Palestinian people. Humanity and the international community must react now.
The undersigned associations of lawyers issue an appeal to all governments, particularly those of the European Union and the BRICS, so that the next session of the General Assembly decides, following the model of Resolution 377(V) “Uniting for Peace,” on binding measures under Chapter VII of the Charter, which provide for:
1. Sanctions against Israel leading to its total isolation from the rest of the world.
2. The immediate interruption of all military cooperation with Israel and the cessation of arms transfers to its territory.
3. The recommendation to all States
a) to refer to the International Court of Justice the States who are authors or complicit in genocide
b) to refer to the International Criminal Court of the individuals who are authors and complicit in the genocide
c) to prosecute acts of genocide under principle of universal jurisdiction, which is an obligation for all States.
4. The immediate formation of an international humanitarian and military intervention force to put an end to the genocide, allow aid to reach the Palestinian people, and prevent the colonization of the West Bank.
The “Uniting for Peace” mechanism, which boasts numerous precedents, makes it possible to overcome the veto imposed in the Security Council by the United States or other permanent members.
Action must be taken immediately. Future generations will not forgive us for complicity, indifference, and inaction in the face of the worst crime of the Third Millennium and the countless violations of international law perpetrated by Israel. The massacre and impunity must end now. The UN General Assembly must adopt the necessary measures just indicated.

L’aggressione genocidaria israeliana contro i palestinesi sta causando nuove vittime ogni giorno. Le Nazioni Unite hanno ufficialmente accertato l’esistenza di una situazione di carestia diffusa a Gaza, deliberatamente provocata dal governo israeliano come parte della sua strategia genocidaria volta ad attuare la sua soluzione finale contro il popolo palestinese. L’umanità e la comunità internazionale devono reagire ora.
Le associazioni di giuristi sottoscritte lanciano un appello a tutti i governi, in particolare a quelli dell’Unione Europea e dei BRICS, affinché la prossima sessione dell’Assemblea Generale decida, seguendo il modello della Risoluzione 377(V) “Uniting for Peace”, misure vincolanti ai sensi del Capitolo VII della Carta, che prevedano:
1. Sanzioni contro Israele che portino al suo isolamento totale dal resto del mondo.
2. L’immediata interruzione di ogni cooperazione militare con Israele e la cessazione dei trasferimenti di armi verso il suo territorio.
3. La raccomandazione a tutti gli Stati
a) di deferire alla Corte Internazionale di Giustizia gli Stati autori o complici del genocidio;
b) di deferire alla Corte Penale Internazionale gli individui autori e complici del genocidio;
c) di perseguire gli atti di genocidio in base al principio di giurisdizione universale, che è obbligo per tutti gli Stati.
4. L’immediata costituzione di una forza internazionale umanitaria e militare per porre fine al genocidio, consentire gli aiuti al popolo palestinese e impedire la colonizzazione della Cisgiordania.
Il meccanismo “Uniting for Peace”, che vanta numerosi precedenti, consente di superare il veto imposto nel Consiglio di Sicurezza dagli Stati Uniti o da altri membri permanenti.
Occorre agire immediatamente. Le future generazioni non ci perdoneranno complicità, indifferenza e inattività di fronte al crimine più grave del Terzo Millennio e alle innumerevoli violazioni del diritto internazionale perpetrate da Israele. Il massacro e l’impunità devono finire ora. L’Assemblea Generale dell’ONU deve adottare le misure necessarie appena indicate.

La agresión genocida israelí contra los palestinos está causando nuevas víctimas cada día. Las Naciones Unidas han establecido oficialmente la existencia de una situación de hambruna generalizada en Gaza, deliberadamente provocada por el gobierno israelí como parte de su estrategia genocida destinada a implementar su solución final contra el pueblo palestino. La humanidad y la comunidad internacional deben reaccionar ahora.
Las asociaciones de juristas firmantes hacen un llamamiento a todos los gobiernos, en particular a los de la Unión Europea y los BRICS, para que la próxima sesión de la Asamblea General decida, siguiendo el modelo de la Resolución 377(V) “Uniting for Peace”, medidas vinculantes en virtud del Capítulo VII de la Carta, que contemplen:
1. Sanciones contra Israel que conduzcan a su aislamiento total del resto del mundo.
2. La interrupción inmediata de toda cooperación militar con Israel y el cese de las transferencias de armas a su territorio.
3. La recomendación a todos los Estados

El mecanismo “Uniting for Peace”, que cuenta con numerosos precedentes, permite superar el veto impuesto en el Consejo de Seguridad por Estados Unidos u otros miembros permanentes.
Debe actuarse de inmediato. Las futuras generaciones no nos perdonarán la complicidad, la indiferencia y la inacción frente al peor crimen del Tercer Milenio y las innumerables violaciones del derecho internacional perpetradas por Israel. La masacre y la impunidad deben terminar ahora. La Asamblea General de la ONU debe adoptar las medidas necesarias recién indicadas.

L’agression génocidaire israélienne contre les Palestiniens fait chaque jour de nouvelles victimes. Les Nations Unies ont officiellement établi l’existence d’une situation de famine généralisée à Gaza, délibérément provoquée par le gouvernement israélien dans le cadre de sa stratégie génocidaire visant à mettre en œuvre sa solution finale contre le peuple palestinien. L’humanité et la communauté internationale doivent réagir maintenant.
Les associations de juristes signataires lancent un appel à tous les gouvernements, en particulier ceux de l’Union européenne et des BRICS, afin que la prochaine session de l’Assemblée générale décide, sur le modèle de la Résolution 377(V) “Uniting for Peace”, de mesures contraignantes en vertu du Chapitre VII de la Charte, prévoyant :
1. Des sanctions contre Israël conduisant à son isolement total du reste du monde.
2. L’interruption immédiate de toute coopération militaire avec Israël et la cessation des transferts d’armes vers son territoire.

Il faut agir immédiatement. Les générations futures ne nous pardonneront pas la complicité, l’indifférence et l’inaction face au pire crime du Troisième millénaire et aux innombrables violations du droit international commises par Israël. Le massacre et l’impunité doivent cesser maintenant. L’Assemblée générale de l’ONU doit adopter les mesures nécessaires ainsi indiquées.

Призыв задействовать механизм «Объединение ради мира»
Израильская геноцидная агрессия против палестинцев ежедневно приводит к новым жертвам. Организация Объединённых Наций официально установила существование ситуации массового голода в Газе, преднамеренно вызванного израильским правительством как часть его геноцидной стратегии, направленной на реализацию «окончательного решения» в отношении палестинского народа. Человечество и международное сообщество должны реагировать сейчас.
Подписавшие это обращение ассоциации юристов призывают все правительства, особенно правительства Европейского союза и БРИКС, чтобы на следующей сессии Генеральной Ассамблеи было принято решение — по образцу Резолюции 377(V) «Объединение ради мира» — о принятии обязательных мер в соответствии с Главой VII Устава, предусматривающих:
1. Санкции против Израиля, ведущие к его полнейшей изоляции от остального мира.
2. Немедленное прекращение любого военного сотрудничества с Израилем и прекращение передачи вооружений на его территорию.
3. Рекомендацию всем государствам:

Механизм «Объединение ради мира», имеющий многочисленные прецеденты, позволяет преодолеть вето, наложенное в Совете Безопасности США или другими постоянными членами.
Действовать необходимо немедленно. Будущие поколения не простят нам соучастие, равнодушие и бездействие перед лицом худшего преступления Третьего тысячелетия и бесчисленных нарушений международного права, совершаемых Израилем. Резня и безнаказанность должны прекратиться сейчас. Генеральная Ассамблея ООН должна принять необходимые меры, изложенные выше.

نداء لتفعيل آلية “الاتحاد من أجل السلام”
إن العدوان الإبادي الإسرائيلي ضد الشعب الفلسطيني يحصد ضحايا جدداً كل يوم. وقد أكدت الأمم المتحدة رسمياً وجود حالة مجاعةواسعة النطاق في غزة، تسبّب بها عمداً الكيان الإسرائيلي كجزء من استراتيجيته الإبادية الهادفة إلى تنفيذ “الحل النهائي” ضد الشعبالفلسطيني. إن الإنسانية والمجتمع الدولي مطالبان بالتحرك الآن.
توجّه الجمعيات الموقّعة من المحامين نداءً إلى جميع الحكومات، وخاصة حكومات الاتحاد الأوروبي ودول البريكس، كي تقرر الجلسة القادمةللجمعية العامة، على غرار القرار 377(V) “الاتحاد من أجل السلام”، اتخاذ تدابير ملزمة بموجب الفصل السابع من الميثاق، تنص على:
1. فرض عقوبات على إسرائيل تؤدي إلى عزلها الكامل عن بقية العالم.

4. التشكيل الفوري لقوة تدخل إنسانية وعسكرية دولية لإنهاء الإبادة، وضمان وصول المساعدات إلى الشعب الفلسطيني، ومنعاستعمار الضفة الغربية.
إن آلية “الاتحاد من أجل السلام”، التي لها سوابق عديدة، تمكّن من تجاوز حق النقض المفروض في مجلس الأمن من قبل الولايات المتحدةأو غيرها من الأعضاء الدائمين.
