E’ fatto notorio che il Governo Israeliano considera terroristi da attaccare in acque internazionali (come peraltro già avvenuto) i coraggiosi cittadini di tutto il mondo che si sono surrogati ai loro governi inerti o complici di fronte al genocidio per bombe, fame e sete, perpetrato a Gaza.
È noto che una flotta di diverse decine di imbarcazioni, talune battenti bandiera italiana sono partite, cariche di cibo e beni di pubblica necessità, al solo fine di fare pervenire queste risorse di vitale importanza alle popolazioni martoriate dalla furia genocida di Israele e dei suoi complici.
Al di là della posizione del Governo Italiano su questa vicenda, si ritiene:
a) che i componenti italiani della Flottiglia agiscano in ottemperanza di un dovere costituzionale e internazionale, discendente dagli articoli 2, 10 e 11 della Carta Costituzionale, alla Carta delle Nazioni Unite e a numerosi accordi internazionali e risoluzioni delle organizzazioni internazionali in materia;
b) che le autorità dello Stato di Israele non hanno alcuna legittimità nell’occupazione dei territori palestinesi e di Gaza, non hanno alcun diritto a vietare di recarsi nella Striscia al fine di portare aiuti alla popolazione ed a controllare le acque prospicenti la Striscia e le acque internazionali o operare fermi e arresti in tali acque;
c) che il Governo italiano sia portatore di un dovere giuridico di protezione dei suoi cittadini quando essi si trovano all’ estero o in acque internazionali e sono minacciati in modo non equivoco di gravissime conseguenze, anche letali, da parte di entità che utilizzano modalità piratesche e terroristiche.
Si ha, infatti, fondato motivo di temere per l’incolumità dei componenti la flotta: basti guardare alle dichiarazioni del Ministro israeliano Ben-Gvir, che ha dichiarato espressamente e chiaramente annunciato (senza essere smentito) che i volontari saranno “trattati da terroristi”; stante anche l’autorità dell’autore delle dichiarazioni, si ha ragione di temere che a tali inaccettabili minacce seguano i fatti.
Diffidiamo perciò il Governo italiano affinché attivi, senza ulteriori ritardi , ogni canale diplomatico per scongiurare le minacciate credibili azioni violente dell’ entità sionista, che oggi si colloca in definitiva e apparentemente irrimediabile violazione della legalità internazionale, assicurando inoltre adeguata protezione anche mediante la marina militare (come avviene in altre aree marine a protezione dei natanti contro atti di pirateria).
I sottoscritti considererebbero tale omissione come ulteriore prova della complicità del Governo Italiano con quello Israeliano nel perpetrare il genocidio.
Ci riserviamo ogni ulteriore azione presso qualunque giurisdizione competente nei confronti del governo israeliano e di altri governi, fra cui quello italiano, per azioni o omissioni che mettano a repentaglio la sicurezza dei volontari impegnati in questa meritoria attività a difesa dell’umanità e dei suoi diritti inviolabili.

It is a matter of public record that the Israeli Government considers as terrorists—thus subject to attack in international waters (as has already occurred)—the courageous citizens from all over the world who have stepped in where their governments remained inert or complicit in the face of genocide through bombs, hunger, and thirst, perpetrated in Gaza.
It is known that a fleet of several dozen vessels, some sailing under the Italian flag, has departed loaded with food and essential goods, with the sole aim of delivering these vital resources to populations tormented by Israel’s genocidal fury and that of its accomplices.
Regardless of the Italian Government’s position on this matter, it is held:
a) that the Italian members of the Flotilla are acting in compliance with a constitutional and international duty, deriving from Articles 2, 10 and 11 of the Italian Constitution, from the UN Charter, and from numerous international agreements and resolutions of international organizations;
b) that the authorities of the State of Israel have no legitimacy in the occupation of Palestinian territories and Gaza, no right to prohibit travel to the Strip in order to deliver aid to the population, nor to control the waters adjacent to the Strip and international waters, nor to conduct seizures and arrests therein;
c) that the Italian Government bears a legal duty to protect its citizens when abroad or in international waters, where they face unequivocal threats of extremely grave, even lethal, consequences from entities employing piratical and terrorist methods.
There is, in fact, well-founded reason to fear for the safety of the flotilla members: suffice it to recall the statements of Israeli Minister Ben-Gvir, who has expressly and clearly declared (without being refuted) that the volunteers will be “treated as terrorists.” Given the authority of the person making such statements, there is reason to believe that these unacceptable threats may be followed by action.
We therefore formally call upon the Italian Government to activate, without further delay, every diplomatic channel to avert the threatened credible violent actions of the Zionist entity, which today stands in definitive and seemingly irreparable violation of international legality, and furthermore to ensure adequate protection, including through the navy (as is customary in other maritime areas to protect vessels from acts of piracy).
The undersigned would consider any omission in this regard as further proof of the Italian Government’s complicity with the Israeli Government in perpetrating genocide.
We reserve every further action before any competent jurisdiction against the Israeli government and other governments, including the Italian one, for acts or omissions endangering the safety of the volunteers engaged in this meritorious activity in defense of humanity and its inalienable rights.

Es un hecho notorio que el Gobierno israelí considera terroristas —y, por lo tanto, objetivos a atacar en aguas internacionales (como ya ha sucedido)— a los valientes ciudadanos de todo el mundo que han suplido a sus gobiernos inertes o cómplices frente al genocidio por bombas, hambre y sed perpetrado en Gaza.
Es sabido que una flota de varias decenas de embarcaciones, algunas con pabellón italiano, ha zarpado cargada de alimentos y bienes de primera necesidad, con el único fin de hacer llegar estos recursos vitales a las poblaciones martirizadas por la furia genocida de Israel y sus cómplices.
Más allá de la posición del Gobierno italiano sobre esta cuestión, se considera:
a) que los integrantes italianos de la Flotilla actúan en cumplimiento de un deber constitucional e internacional, derivado de los artículos 2, 10 y 11 de la Constitución italiana, de la Carta de las Naciones Unidas y de numerosos acuerdos y resoluciones internacionales;
b) que las autoridades del Estado de Israel no tienen legitimidad alguna en la ocupación de los territorios palestinos y de Gaza, ni derecho a prohibir el acceso a la Franja para llevar ayuda a la población, ni a controlar las aguas adyacentes a la Franja y las aguas internacionales, ni a realizar detenciones en ellas;
c) que el Gobierno italiano tiene el deber jurídico de proteger a sus ciudadanos cuando se encuentran en el extranjero o en aguas internacionales y son amenazados de manera inequívoca con gravísimas consecuencias, incluso letales, por entidades que emplean métodos piratas y terroristas.
Existe, de hecho, motivo fundado para temer por la seguridad de los integrantes de la flota: basta recordar las declaraciones del Ministro israelí Ben-Gvir, quien ha afirmado expresa y claramente (sin ser desmentido) que los voluntarios serán “tratados como terroristas.” Dada la autoridad de quien pronunció tales palabras, existe razón para temer que esas amenazas inaceptables se materialicen.
Por ello, intimamos al Gobierno italiano para que active, sin más demora, todos los canales diplomáticos a fin de conjurar las creíbles amenazas de acciones violentas por parte de la entidad sionista, que hoy se sitúa en una violación definitiva y aparentemente irreparable de la legalidad internacional, garantizando además una protección adecuada incluso mediante la marina militar (como ocurre en otras zonas marítimas para proteger a las embarcaciones contra actos de piratería).
Los abajo firmantes considerarían tal omisión como una prueba más de la complicidad del Gobierno italiano con el israelí en la perpetración del genocidio.
Nos reservamos todo ulterior recurso ante cualquier jurisdicción competente contra el gobierno israelí y otros gobiernos, incluido el italiano, por acciones u omisiones que pongan en riesgo la seguridad de los voluntarios comprometidos en esta loable actividad en defensa de la humanidad y de sus derechos inalienables.

Il est notoire que le Gouvernement israélien considère comme terroristes —et donc comme cibles à attaquer en eaux internationales (comme cela s’est déjà produit)— les courageux citoyens du monde entier qui se sont substitués à leurs gouvernements inertes ou complices face au génocide par les bombes, la faim et la soif perpétré à Gaza.
Il est connu qu’une flotte de plusieurs dizaines de navires, dont certains battant pavillon italien, a pris la mer chargée de vivres et de biens de première nécessité, dans le seul but de livrer ces ressources vitales aux populations martyrisées par la fureur génocidaire d’Israël et de ses complices.
Indépendamment de la position du Gouvernement italien sur cette affaire, il est considéré :
a) que les membres italiens de la Flottille agissent en exécution d’un devoir constitutionnel et international, découlant des articles 2, 10 et 11 de la Constitution italienne, de la Charte des Nations Unies et de nombreux accords et résolutions internationaux ;
b) que les autorités de l’État d’Israël n’ont aucune légitimité dans l’occupation des territoires palestiniens et de Gaza, aucun droit d’interdire l’accès à la Bande afin d’y apporter de l’aide à la population, ni de contrôler les eaux adjacentes à la Bande et les eaux internationales, ni d’y procéder à des arraisonnements ou arrestations ;
c) que le Gouvernement italien a l’obligation juridique de protéger ses citoyens lorsqu’ils se trouvent à l’étranger ou en eaux internationales et sont menacés de manière non équivoque de conséquences extrêmement graves, voire létales, de la part d’entités recourant à des méthodes pirates et terroristes.
Il existe en effet de sérieuses raisons de craindre pour la sécurité des membres de la flotte : il suffit de rappeler les déclarations du Ministre israélien Ben-Gvir, qui a expressément et clairement affirmé (sans être démenti) que les volontaires seront « traités comme des terroristes ». Étant donné l’autorité de l’auteur de ces déclarations, il y a lieu de craindre que ces menaces inacceptables se traduisent en actes.
Nous mettons donc en demeure le Gouvernement italien d’activer, sans plus de retard, tous les canaux diplomatiques pour prévenir les actions violentes crédibles annoncées par l’entité sioniste, laquelle se trouve aujourd’hui en violation définitive et apparemment irréparable de la légalité internationale, et d’assurer en outre une protection adéquate, y compris par le biais de la marine militaire (comme c’est le cas dans d’autres zones maritimes pour protéger les navires contre les actes de piraterie).
Les soussignés considéreraient toute omission à cet égard comme une preuve supplémentaire de la complicité du Gouvernement italien avec le Gouvernement israélien dans la perpétration du génocide.
Nous nous réservons toute action ultérieure devant toute juridiction compétente contre le gouvernement israélien et d’autres gouvernements, y compris l’italien, pour des actions ou omissions mettant en danger la sécurité des volontaires engagés dans cette activité méritoire en défense de l’humanité et de ses droits inaliénables.

Общеизвестно, что израильское правительство считает террористами — и, следовательно, целями для нападения в международных водах (что уже происходило ранее) — мужественных граждан всего мира, которые заменили свои бездействующие или соучаствующие правительства перед лицом геноцида, совершаемого в Газе посредством бомб, голода и жажды.
Известно, что флотилия из нескольких десятков судов, некоторые из которых идут под итальянским флагом, вышла в море, нагруженная продовольствием и предметами первой необходимости, с единственной целью доставить эти жизненно важные ресурсы населению, измученному геноцидной яростью Израиля и его сообщников.
Независимо от позиции итальянского правительства по этому вопросу, утверждается:
a) что итальянские участники Флотилии действуют во исполнение конституционного и международного долга, вытекающего из статей 2, 10 и 11 Конституции Италии, Устава ООН и многочисленных международных соглашений и резолюций;
b) что власти государства Израиль не имеют никакой легитимности в оккупации палестинских территорий и Газы, не имеют права запрещать въезд в сектор для доставки гуманитарной помощи населению, контролировать прибрежные воды сектора и международные воды, а также осуществлять там задержания и аресты;
c) что итальянское правительство несет юридическую обязанность защищать своих граждан, когда они находятся за рубежом или в международных водах и подвергаются однозначным угрозам крайне тяжёлых, в том числе смертельных, последствий со стороны структур, использующих пиратские и террористические методы.
Существует обоснованная причина опасаться за безопасность членов флотилии: достаточно вспомнить заявления израильского министра Бен-Гвира, который ясно и прямо заявил (и не был опровергнут), что волонтёры будут «рассматриваться как террористы». Учитывая авторитет лица, сделавшего такие заявления, есть все основания опасаться, что этим неприемлемым угрозам последуют действия.
Поэтому мы предупреждаем итальянское правительство, чтобы оно без дальнейших задержек задействовало все дипломатические каналы для предотвращения угрозы насильственных действий со стороны сионистской структуры, которая сегодня окончательно и, по-видимому, необратимо нарушает нормы международного права, и обеспечило надлежащую защиту, включая военно-морскую (как это делается в других морских районах для защиты судов от актов пиратства).
Подписавшиеся будут рассматривать любое бездействие в этом отношении как дополнительное доказательство соучастия итальянского правительства с израильским в совершении геноцида.
Мы оставляем за собой право на любые дальнейшие действия в любой компетентной юрисдикции против правительства Израиля и других правительств, включая итальянское, за действия или бездействие, которые ставят под угрозу безопасность добровольцев, участвующих в этой достойной деятельности во имя защиты человечества и его неотъемлемых прав.

据悉，一支由数十艘船只组成的舰队，其中部分悬挂意大利国旗，已启航，装载着食品与生活必需品，唯一目的就是将这些至关重要的资源送达因以色列及其同谋的种族灭绝暴行而遭受苦难的民众。
无论意大利政府在此事上的立场如何，应当承认：
a) 意大利舰队成员的行动符合宪法与国际义务，源自意大利宪法第2、10和11条、《联合国宪章》以及多项国际协定和国际组织的决议；
b) 以色列当局在占领巴勒斯坦领土和加沙方面毫无合法性，无权禁止进入加沙地带以向平民提供援助，无权控制加沙沿岸水域及国际水域，更无权在这些水域进行拦截或逮捕；
c) 意大利政府在其公民身处国外或国际水域并明确遭受来自以海盗与恐怖主义方式行事的实体所发出的严重甚至致命威胁时，负有法律上的保护义务。
事实上，有充分理由担心舰队成员的人身安全：仅需提及以色列部长本-格维尔的声明，他已明确无误地宣布（且未被驳斥），志愿者将被“当作恐怖分子对待”。鉴于其职位与权威，有理由担心这些不可接受的威胁将付诸实施。
因此，我们郑重敦促意大利政府立即启动一切外交渠道，以防止该犹太复国主义实体所威胁的可信暴力行为；该实体当下已彻底且似乎不可逆转地违反了国际法。同时，还应确保提供适当的保护，包括通过海军（正如在其他海域为保护船只免遭海盗袭击时所采取的措施）。
若意大利政府对此袖手旁观，签署人将视之为其与以色列政府共同实施种族灭绝的又一确凿证据。
我们保留在任何有管辖权的司法机构前，针对以色列政府及其他政府（包括意大利政府），因任何危及志愿者安全的行为或不作为，采取进一步法律行动的权利。

إن الموقّعين أدناه — المحامي ستيفانو أندRADE فاخاردو (نقابة محامي فيرونا)، المحامية ميكيلا أريكالـي (أفيليـنو)، المحامي فاوستو جيانيلي (مودينا)، المحامي كلاوديو جانجياكومو (روما)، المحامي فابيو مارشيلي (فيليتري)، الأستاذ أوغو ماتيي، أستاذ القانون المدني بجامعة تورينو، المحامي جيلبيرتو باغاني (ميلانو)، المحامية ميكيلا بوليتي (ماسا كارارا)، المحامي لوكا سالتالاماكّيا (نابولي)، المحامي جانلوكا فيتالي (تورينو) — وقد اختاروا مقرهم لهذا الغرض في مكتب المحامي جانلوكا فيتالي، تورينو، شارع تشيبـراريو 12، البريد الإلكتروني الرسمي: gianlucavitale@pec.ordineavvocatitorino.it، والمفوَّض بإيداع هذا الإنذار، يعلنون ما يلي:
من المعروف أن الحكومة الإسرائيلية تعتبر المواطنين الشجعان من مختلف أنحاء العالم — الذين قاموا مقام حكوماتهم العاجزة أو المتواطئة إزاء الإبادة الجماعية بالقصف والجوع والعطش المرتكبة في غزة — “إرهابيين”، وبالتالي أهدافاً للهجوم في المياه الدولية (كما حدث فعلاً في السابق).
ومن المعلوم أن أسطولاً مكوّناً من عشرات السفن، بعضها يرفع العلم الإيطالي، قد أبحر محمّلاً بالغذاء والمواد الأساسية، بهدف وحيد هو إيصال هذه الموارد الحيوية إلى الشعوب التي أنهكتها جرائم الإبادة التي يمارسها الكيان الإسرائيلي وحلفاؤه.
وبغض النظر عن موقف الحكومة الإيطالية من هذه القضية، فإننا نؤكد:
a) أن أعضاء الأسطول الإيطاليين يتصرفون وفقاً لواجب دستوري ودولي، نابع من المواد 2 و10 و11 من الدستور الإيطالي، ومن ميثاق الأمم المتحدة، ومن العديد من الاتفاقيات والقرارات الدولية؛
b) أن سلطات الكيان الإسرائيلي لا تملك أي شرعية في احتلال الأراضي الفلسطينية وقطاع غزة، ولا أي حق في منع الوصول إلى القطاع لإيصال المساعدات للسكان، ولا في السيطرة على المياه المحاذية للقطاع أو المياه الدولية، أو القيام بعمليات توقيف واعتقال فيها؛
c) أن الحكومة الإيطالية تتحمّل واجباً قانونياً بحماية مواطنيها عندما يتواجدون في الخارج أو في المياه الدولية، حيث يتعرضون لتهديدات واضحة بعواقب جسيمة، قد تكون مميتة، من قبل جهات تستخدم أساليب قرصنة وإرهاب.
وهناك بالفعل أسباب وجيهة للخوف على سلامة أفراد الأسطول: يكفي التذكير بتصريحات الوزير الإسرائيلي بن غفير، الذي أعلن صراحة ووضوحاً (من دون أي تكذيب) أن المتطوعين سيُعاملون “كإرهابيين”. وبالنظر إلى مكانة صاحب هذه التصريحات، هناك ما يدعو للاعتقاد أن تلك التهديدات غير المقبولة قد تتحول إلى أفعال.
وعليه، فإننا ننذر الحكومة الإيطالية بوجوب تفعيل جميع القنوات الدبلوماسية فوراً، ومن دون أي تأخير، لتجنب الأفعال العنيفة المهددة والجدّية الصادرة عن الكيان الصهيوني، الذي يوجد اليوم في حالة انتهاك نهائي — ويبدو أنه غير قابل للإصلاح — للشرعية الدولية. كما نطالب بتوفير الحماية الكافية بما في ذلك عن طريق البحرية العسكرية (كما هو الحال في مناطق بحرية أخرى لحماية السفن من أعمال القرصنة).
وسيُعتبر أي امتناع عن ذلك دليلاً إضافياً على تواطؤ الحكومة الإيطالية مع الحكومة الإسرائيلية في ارتكاب الإبادة الجماعية.
ونحتفظ بحقّنا في اتخاذ أي إجراءات أخرى أمام أي ولاية قضائية مختصة ضد الحكومة الإسرائيلية وحكومات أخرى، بما فيها الحكومة الإيطالية، عن أي أفعال أو امتناعات تعرض سلامة المتطوعين المنخرطين في هذا العمل النبيل دفاعاً عن الإنسانية وحقوقها غير القابلة للتصرف للخطر.
