Il Centro di ricerca ed elaborazione per la democrazia (CRED) rilancia il seguente comunicato degli Avvocati e Giuristi contro il Genocidio che stigmatizza la decisione del Consiglio nazionale forense di non tenere in presenza l’incontro con la Relatrice Speciale sui diritti umani nei Territori occupati, Francesca Albanese.
Siamo centinaia di giuriste, giuristi, avvocate ed avvocati, estremamente preoccupati per la deriva antigiuridica che sta pervadendo anche nelle nostre categorie ogni tentativo di parlare del dramma palestinese, per lo spregio dei più fondamentali diritti umani, per gli attacchi al sistema di diritto e di giustizia internazionale nato dopo il dramma del nazifascismo che sembra pervadere il discorso pubblico. Esprimiamo, pertanto, il nostro sconcerto per la decisione del Consiglio nazionale forense di non tenere in presenza il previsto incontro del 4 settembre con la Relatrice Speciale sui diritti umani nei Territori palestinesi occupati, dottoressa Francesca Albanese. Tale inopinata decisione, adottata adducendo motivi di presunto ordine pubblico, è l’ingiustificabile risposta a centinaia di messaggi di posta elettronica e all’Appello firmato da circa cinquecento avvocati e giuristi che contestavano lo snaturamento del dibattito originariamente previsto, avvenuto affiancando alla dottoressa Albanese un paio di interventi il cui unico titolo di competenza era la netta sintonia con il governo israeliano autore del genocidio a Gaza cui assistiamo ogni giorno costernati e impotenti. Ciò nonostante la dottoressa Albanese, pur motivatamente perplessa, aveva confermato il suo impegno ad essere presente anche perché aveva ricevuto moltissimi messaggi di solidarietà e che esprimevano l‘insopprimibile volontà della base forense ad incontrarla. Ma, lungi dal rigettare fermamente quelle pressioni e riaffermare la centralità, tanto più tra giuristi, del rispetto del diritto e delle istituzioni internazionali che perseguono la pace e la giustizia tra le nazioni, evidentemente il Consiglio ha preferito cedere a quelle istanze con una decisione irrispettosa dell’illustre ospite e della dignità professionale dei relatori inizialmente previsti (tra cui l’avv. Barbara Spinelli, Co-Presidente della European Lawyers Association for Democracy and Human Rights) e dei colleghi e delle colleghe che avevano deciso di presenziare all’evento.
Ci rifiutiamo di credere che gli insulti, le diffamazioni e le minacce provenienti da una sparuta pattuglia di sionisti estremisti possano costituire un motivo adeguato per sottrarre alle avvocate e agli avvocati italiani la possibilità di incontrare dal vivo una nostra connazionale che sta svolgendo con impegno ed onore un compito tanto importante.
Ribadiamo l’invito a seguire comunque l’incontro online con la Relatrice Speciale ed invitiamo tutti all’incontro con la dottoressa Albanese che si terrà a Roma il prossimo sabato 13 settembre alle ore 19 alla Città dell’Altreconomia nell’ambito del Festival “Falastin”.

The Research and Analysis Centre for Democracy (CRED) forwards the following statement from Lawyers and Jurists Against Genocide, which denounces the decision of the Italian National Bar Council not to hold the meeting with the United Nations Special Rapporteur on human rights in the occupied territories, Francesca Albanese, in person.
Hundreds of legal professionals—jurists and lawyers alike—are deeply concerned about the rising disregard for law within our ranks regarding any attempt to address the Palestinian tragedy, the contempt for our most fundamental human rights, and the attacks on the international legal and justice system born after the horrors of National Socialism and Fascism, which seem increasingly pervasive in public discourse. We therefore express our dismay at the National Bar Council’s decision not to hold the planned in-person meeting scheduled for 4 September with UN Special Rapporteur on human rights in the Occupied Palestinian Territories, Dr. Francesca Albanese. This inexplicable decision, justified on purported grounds of public order, constitutes an unjustifiable response to hundreds of emails and to the Appeal signed by nearly five hundred lawyers and jurists protesting the distortion of the originally intended discussion—namely, the addition of a couple of speakers whose sole qualification was their apparent alignment with the Israeli government, which is responsible for the genocide in Gaza that we witness every day with dismay and helplessness. Despite her justified reservations, Dr. Albanese had confirmed her commitment to attend, especially since she had received numerous messages of solidarity expressing the legal community’s inextinguishable desire to meet her. Yet, instead of firmly rejecting those pressures and reaffirming the centrality—especially among jurists—of respect for the law and international institutions dedicated to peace and justice among nations, the Council evidently chose to yield to those pressures. This decision disrespected the distinguished guest, the professional dignity of the initially announced speakers (among them, lawyer Barbara Spinelli, Co-President of the European Lawyers Association for Democracy and Human Rights), and the colleagues who had decided to attend the event.
We refuse to believe that insults, defamatory attacks, and threats from a small group of extremist Zionists could justify denying Italian lawyers the opportunity to meet in person with one of our compatriots who is performing such an important duty with commitment and honor.
We reaffirm our invitation to follow the meeting online with the Special Rapporteur, and we invite everyone to the meeting with Dr. Albanese, to be held in Rome on Saturday, 13 September at 19:00 at the Città dell’Altreconomia as part of the “Falastin” Festival.

El Centro de Investigación y Elaboración para la Democracia (CRED) difunde el siguiente comunicado de Abogados y Juristas contra el Genocidio, que rechaza la decisión del Consejo Nacional Forense de no realizar presencialmente el encuentro con la Relatora Especial sobre derechos humanos en los territorios ocupados, Francesca Albanese.
Cientos de profesionales del derecho—juristas y abogados—estamos profundamente preocupados por la deriva antijurídica que se está infiltrando en nuestras categorías ante cualquier intento de hablar del drama palestino, el menosprecio de los derechos humanos más fundamentales, y los ataques al sistema de derecho y justicia internacional nacido tras la tragedia del nazifascismo, que parecen permear el discurso público. Manifestamos, por tanto, nuestra indignación por la decisión del Consejo Nacional Forense de no realizar en persona la prevista reunión del 4 de septiembre con la Relatora Especial sobre derechos humanos en los Territorios Palestinos Ocupados, la doctora Francesca Albanese. Dicha decisión inesperada, adoptada bajo el pretexto de supuesto orden público, es una respuesta injustificable a cientos de mensajes de correo electrónico y al Llamamiento firmado por casi quinientos abogados y juristas que cuestionaban la desnaturalización del debate originalmente previsto, al añadirse a la doctora Albanese un par de intervenciones cuyo único mérito era su alineamiento exclusivo con el gobierno israelí, autor del genocidio en Gaza que contemplamos cada día con consternación e impotencia. A pesar de sus plenamente justificadas reservas, la doctora Albanese había confirmado su compromiso de asistir, también porque había recibido numerosos mensajes de solidaridad que expresaban la voluntad inquebrantable de la base forense de encontrarse con ella. Pero, lejos de rechazar con firmeza esas presiones y reafirmar la centralidad —especialmente entre los juristas— del respeto al derecho y a las instituciones internacionales que persiguen la paz y la justicia entre los pueblos, el Consejo evidentemente prefirió ceder a esas solicitudes, con una decisión irrespetuosa hacia la ilustre invitada, la dignidad profesional de los ponentes inicialmente previstos (entre ellos, la abogada Barbara Spinelli, copresidenta de la European Lawyers Association for Democracy and Human Rights) y de los colegas que habían decidido asistir al evento.
Nos negamos a creer que los insultos, las difamaciones y las amenazas provenientes de una reducida fracción de sionistas extremistas puedan constituir una razón adecuada para privar a los abogados y abogadas italianos de la oportunidad de encontrarse en persona con una compatriota que está desempeñando con compromiso y honor una función tan importante.
Reiteramos la invitación a seguir igualmente el encuentro en línea con la Relatora Especial e invitamos a todos al encuentro con la doctora Albanese que tendrá lugar en Roma el próximo sábado 13 de septiembre a las 19:00 en la Città dell’Altreconomia, en el marco del Festival “Falastin”.

Le Centre de Recherche et d’Élaboration pour la Démocratie (CRED) relaie la déclaration suivante des Avocats et Juristes contre le Génocide, qui stigmatise la décision du Conseil National Forens de ne pas tenir en présentiel la rencontre avec la Rapporteuse Spéciale des Nations Unies aux droits de l’homme dans les Territoires occupés, Francesca Albanese.
Nous sommes des centaines de juristes et avocates/avocats, extrêmement préoccupé·es par la dérive anti-juridique qui s’infiltre dans nos rangs à chaque tentative de parler du drame palestinien, du mépris des droits humains les plus fondamentaux, des attaques contre le système de droit et de justice international né après la tragédie du nazisme et du fascisme, qui semble imprégner le discours public. Nous exprimons donc notre consternation face à la décision du Conseil National Forens de ne pas tenir en présentiel la rencontre prévue le 4 septembre avec la Rapporteuse Spéciale aux Droits de l’homme dans les Territoires Palestiniens Occupés, docteure Francesca Albanese. Cette décision inopinée, motivée par des raisons prétendues d’ordre public, constitue une réponse injustifiable à des centaines de courriels et à l’Appel signé par près de cinq cents avocates et avocats et juristes, qui contestaient la dénaturation du débat initial tel qu’il avait été prévu, auquel s’étaient ajoutés deux intervenants dont la seule légitimité résidait dans leur alignement net avec le gouvernement israélien auteur du génocide à Gaza que nous observons chaque jour, consterné·es et impuissant·es. Malgré ses légitimes réticences, la docteure Albanese avait confirmé son engagement à être présente, notamment parce qu’elle avait reçu de nombreux messages de solidarité exprimant la volonté irrépressible de la base forense de la rencontrer. Mais, loin de repousser fermement ces pressions et de réaffirmer la centralité, d’autant plus parmi les juristes, du respect du droit et des institutions internationales œuvrant pour la paix et la justice entre les nations, le Conseil a apparemment préféré céder à ces instances, par une décision irrespectueuse à l’égard de l’illustre invitée, de la dignité professionnelle des intervenant·es initialement prévu·es (dont l’avocate Barbara Spinelli, co-présidente de la European Lawyers Association for Democracy and Human Rights) et des collègues qui avaient décidé d’assister à l’événement.
Nous refusons de croire que les insultes, diffamations et menaces émanant d’une petite faction de sionistes extrémistes puissent constituer un motif valable pour priver les avocates et avocats italiens de la possibilité de rencontrer en personne une consœur ou un confrère qui accomplit avec engagement et honneur une mission d’une telle importance.
Nous réaffirmons notre invitation à suivre néanmoins la rencontre en ligne avec la Rapporteuse Spéciale et invitons toutes et tous à la rencontre avec la docteure Albanese qui se tiendra à Rome le samedi 13 septembre à 19h, à la Città dell’Altreconomia, dans le cadre du Festival « Falastin ».

Центр исследований и разработки в области демократии (CRED) публикует следующую декларацию от Адвокатов и юристов против геноцида, в которой осуждается решение Национального совета адвокатуры (Consiglio Nazionale Forense) не проводить личную встречу с Специальным докладчиком ООН по правам человека в оккупированных территориях, Франческой Альбанезе.
Мы — сотни юристов, адвокатов, глубоко обеспокоены правовой деградацией, проникающей в наши ряды при попытках говорить о палестинской трагедии, о неуважении к основнейшим правам человека, о нападках на систему международного права и юстиции, возникшую после нацистской и фашистской катастрофы, которая, похоже, всё больше проникает в публичный дискурс. Мы выражаем своё возмущение решением Национального совета адвокатуры не проводить запланированную на 4 сентября личную встречу со Специальным докладчиком ООН Франческой Альбанезе. Это неожиданное решение, объяснённое якобы обеспокоенностью общественным порядком, — необоснованный ответ на сотни электронных писем и на Апелляцию, подписанную почти пятьюстами адвокатами и юристами, которые оспаривали искажение первоначально предусмотрённого формата дискуссии. Вместо этого рядом с доктором Альбанезе вводятся два докладчика, чьё единственное основание — явная поддержка израильского правительства, которое совершает геноцид в Газе, свидетелями которого мы ежедневно становимся с ужасом и беспомощностью. Несмотря на мотивированное сомнение, доктор Альбанезе подтвердила своё намерение присутствовать лично, поскольку получила множество сообщений солидарности, выражающих несокрушимую готовность судебной профессии встретиться с ней. Однако вместо того, чтобы решительно отклонить давление и вновь доказать, что уважение к закону и международным институтам является центральным для юристов, Совет предпочёл уступить этому давлению, приняв решение, неуважительное к почтенной гостье, к профессиональному достоинству первоначально предусмотренных докладчиков (в числе которых адвокат Барбара Спинелли, сопредседатель Европейской ассоциации юристов за демократию и права человека), и к коллегам, которые собрались принять участие в мероприятии.
Мы отказываемся верить, что оскорбления, клевета и угрозы, исходящие от небольшой группы экстремальных сионистов, могут служить достаточным поводом, чтобы лишить итальянских адвокатов возможности лично встретиться с нашей соотечественницей, которая выполняет столь важную миссию с преданностью и честью.

我们有数百名法律界人士——法学家和律师——极度担忧在我们这个群体中，谈论巴勒斯坦悲剧、对最基本人权的蔑视，以及对战后建立的国际法和国际司法制度的攻击，越来越多地演变为反法律的倾向，这一制度源自纳粹法西斯悲剧，似乎正渗透公众话语。因此，我们对国家律师委员会决定不举办原定于 9 月 4 日与联合国被占领巴勒斯坦领土人权特别报告员阿尔巴内塞博士的面对面会议，表示强烈不满。此项无故决定以所谓公共秩序为由，却是对数百封电子邮件和近 500 名律师、法学家签署的呼吁的不可辩解的回应，他们反对原定讨论被扭曲：阿尔巴内塞博士因其正当疑虑本可确认出席，且她收到了大量表达司法界基础希望与她见面的团结信息，仍坚持出席。但委员会并未坚决拒绝这些压力，也未重申法律及国际机构在推动国家间和平与正义中的核心地位，反而明显向这些压力低头，这一决定对尊贵来宾、最初安排的发言人——包括欧洲律师协会促进民主与人权联合主席律师芭芭拉·斯皮内利——及所有决定出席的同事们都极不尊重。
我们拒绝相信，一小部分极端锡安主义者的侮辱、诽谤和威胁，会成为剥夺意大利律师亲自会见一位尽职尽责、荣誉执行这一重要任务的同胞的正当理由。

يُعيد “مركز البحث والإعداد من أجل الديمقراطية” (CRED) نشر البيان التالي الصادر عن “المحامون وعلماء القانون ضد الإبادة الجماعية”، الذي يستنكر قرار “المجلس الوطني للمحاماة” بعدم عقد لقاء حضوري مع مقررة الأمم المتحدة الخاصة بحقوق الإنسان في الأراضي المحتلة، الدكتورة فرانشيسكا ألبانيزي.
نحن مئات من القانونيين—محامون وعلماء قانون—نشعر بقلق عميق من انحراف اتجاه “مضاد للقانون” الذي يتغلغل داخل فئاتنا تجاه أي محاولة للتطرق إلى المأساة الفلسطينية، وللإساءة العميقة أبسط حقوق الإنسان، وللهجمات على النظام القانوني والعدلي الدولي الذي نشأ بعد فاجعة النازية والفاشية، والذي يبدو أنه يسيطر تدريجيًا على الخطاب العام. لذلك، نعرب عن استيائنا الشديد من قرار “المجلس الوطني للمحاماة” بعدم عقد اللقاء المقرر بتاريخ 4 سبتمبر مع مقررة الأمم المتحدة الخاصة بحقوق الإنسان في الأراضي الفلسطينية المحتلة، الدكتورة فرانشيسكا ألبانيزي، حضورياً. هذا القرار المفاجئ، الذي اتُّخِذ بحجة الحفاظ على “النظام العام” المزعوم، هو رد غير مبرر على مئات الرسائل الإلكترونية و”النداء” الذي وقّعه حوالي خمسمائة محامٍ وعالم قانون، مطالبين بمواجهة الانحراف في جدول الجلسة الأصلية، حيث أُضيف إلى جانب الدكتورة ألبانيزي اثنان من المتدخلين الذين كان مؤهلهما الوحيد توافقهما الواضح مع الحكومة الإسرائيلية، وهي الجهة المسؤولة عن الإبادة الجماعية في غزة التي نشهدها يومياً بذهول وعجز. بالرغم من مبرراتها المشروعة، أكدت الدكتورة ألبانيزي التزامها بالحضور، خصوصًا بعد تلقيها رسائل دعم عدّة تُعبّر عن إرادة القاعدة القانونية اللامتناهية في مقابلتها. لكن المجلس، بدل أن يرفض هذه الضغوط ويُجدّد التأكيد على أن احترام القانون والمؤسسات الدولية التي تسعى إلى السلام والعدالة بين الأمم هو جوهر مهنة القانون، ولّى وجهه نحو الاستجابة لتلك الضغوط. جاء هذا القرار ليُهين الضيفة الموقرة، ولينال من كرامة المتدخلين الأصليين (بينهم المحامية باربارا سبينيلي، الرئيسة المشاركة للـEuropean Lawyers Association for Democracy and Human Rights)، ولزملائنا وزميلاتنا الذين قرروا المشاركة في الحدث.
نرفض أن نصدق أن الإهانات والافتراءات والتهديدات الصادرة عن مجموعة صغيرة من المتطرفين الصهاينة يمكن أن تكون مسوّغًا كافيًا لحرمان المحاميات والمحامين الإيطاليين من لقاء مباشر مع زميلة لنا تقوم بمهمة مهمة، شريفة، وبكل التزام.
نجدد دعوتنا لحضور اللقاء عبر الإنترنت مع المقررة الخاصة، وندعو الجميع لحضور اللقاء مع الدكتورة ألبانيزي الذي سيُعقد في روما يوم السبت 13 سبتمبر الساعة 19:00 في Città dell’Altreconomia، ضمن فعاليات مهرجان “فلسطين” (Falastin).
